products in this catalog subject to the following terms and conditions:

Ownership of Cylinders and
Containers
All cylinders and other containers, including tank trucks and
tube trailers in which are delivered or
shipped shall be and remain the property of
Aero All-Gas Company. The Buyer shall be responsible for the care and condition
of the cylinders and will be responsible for payment for any damage to or
loss of
cylinders, caps, or fittings beyond the normal wear and tear that occurs
while in the Buyer's possession. To prevent contamination or valve damage, all
cylinders should be returned with positive pressure and all valves should be
tightly closed, valve caps or dust plugs in place, and cylinder cap installed.
The Buyer may not loan or refill any cylinder owned by Aero All-Gas and
Equipment Co. as it is prohibited by Federal regulations. Certain products will
be shipped in non-returnable containers.
Non-returnable Cylinders
Aero All-Gas offers a
variety of non-returnable cylinder sizes including lecture bottles and
transportable cylinders. The following definitions will assist in determining
the appropriate container for your application.
·Non-returnable Lecture Bottles (L.B.)
These cylinders are sold outright and therefore have no rental
charges associated with their sale. This package is configured with the standard
CGA 170 or 180-lecture bottle valve. NOTE: Returnable lecture bottles (L.B.I.)
are also available.
·SCOTTYâ Transportable Containers
We supply a
complete line of pure gases and gas mixture in
safe, convenient transportable containers. These containers are sold
outright and therefore have no rental charges associated with their
sale.
Final
disposition of the non-refundable and SCOTTY
â Transportable
containers is the ultimate responsibility of the end user and must be
accomplished in the in safe and environmentally responsible manner and in
accordance with all with all Federal, State, and Local
regulations.
Enviro-Cal Cylinder
The responsible alternative to
disposable cylinders, Enviro-Cal is a calibration gas mixture supplied in a new,
lightweight, and portable aluminum cylinder. This cylinder weighs
approximately 5lbs., holding 170 liters of product at 2000 psig. Most
importantly it is returnable and refillable. This cylinder size is
suitable for most applications, and is offered in two different valve
configurations, CGA-180 and C-10, 5/8 -18UNF. Both valves are available in high
purity stainless steel or brass.
Cylinder Rental
The Aero All-Gas Co.
offers cylinder rental options, in order to recover the cost and maintenance of
the cylinders and ensure they are
returned:

Rental is charged for all returnable cylinders at established daily
rates dependent on cylinder size.
·
Minimum of one month will apply.
·
Annual Lease Agreements are available
for customers who plan to hold cylinders for long
periods.
·
Rental statements are computed. Consolidated, and billed on
an easy-to-read statement at month end.
Delivery
Delivery shall occur
either via trucks operated by Aero All-Gas or an approved common carrier.
Customer pickup at the Aero All-Gas Companys Hartford, Connecticut location is
also available.
Taxes
Prices do not include any
Federal, State or Local taxes or any form of excise tax. The taxes shall be
computed, billed and payable as a separate line item on the
invoice.
Sellers
Warranty
Seller warrants that the
product shall to conform to the specifications and express warranties set forth
here in and that at the time of delivery, Seller shall have good title and right
to transfer the same and that the same shall be delivered free off
encumbrances. The foregoing warranty is the sole warranty and is lieu of
all other warranties, express or implied, in fact or by law, including, without
limiting the generality of the foregoing, any warranty of merchantability or
fitness for a particular purpose.
Limitation of Liability
Buyer acknowledges that
there are hazards associated with the use of the product, that Buyer understands
such hazards, and that it is the responsibility of the Buyer to warn and protect
its employees and others exposed to such hazards through Buyer's storage and use
of the product. Seller shall provide Buyer with copies of Material Safety Data
Sheets (MSDS) relating to the product for Buyer to make such warnings and Buyer
shall hold harmless, indemnify, and defend Seller from and against any liability
incurred by Seller because such warnings were not made. Buyer assumes all risk
and liability for loss, damages, or injury to persons or to property of Buyer or
others arising out of the presence or use of the product.
No claim of any kind with
respect to non-delivery of product shall be greater than the price payable
hereunder for the product in respect to which such claim is made and Buyer's
sole and exclusive remedy (except for the remedy of cancellation for material
default) for delivery of nonconforming product shall be replacement by Seller of
a like quantity of conforming product at no additional cost to
Buyer.
Seller shall not be liable
in contract or tort for any other direct, or any indirect, special, incidental,
or consequential damages arising out of its performance or nonperformance
hereunder.
The Aero All-Gas Technical
Support Center was established as a central resource for our customers who
require technical assistance. The Center is staffed with degreed professionals
whose sole responsibility is assisting in the resolution of technical problems
and the quality of our products. The Center's experienced professionals
